| When 'Web Presence' Creates Jurisdiction
The Web may not be truly worldwide, but it is getting fairly close, and while this has created enormous opportunities, it is not without its challenges. Among the thorniest of these have been issues of jurisdiction, which have been a staple of Web jurisprudence since the earliest days of e-commerce (and even before that). This has only gotten more complex as Web business models have diversified: a modern Web site for a company based in Chicago might be designed in New York, coded in California, supported in India, connected via a Virginia Internet service provider and hosted on servers in the Bahamas (offshore hosting being more and more common for both cost and privacy reasons). More importantly, the company might reasonably expect that site to be viewed by users from Brooklyn to Beijing, and perhaps to be subject to the laws of every jurisdiction in the world.
Targetting Spain - another M11 bomb for another Election?
A certain hysteria has it certain sectors of Spanish & Catalan public opinion following the arrests of 14 suspected Islamist terrorists in the city of Barcelona between Friday night & Saturday morning. In an operation involving the Spanish secret service (the CNI) the Guardia Civil & local regional Catalan police (Mossos d'esquadra) co-ordinated raids made on a bakery, mosque & several flats in the Raval district of central Barcelona. Immediately news services both in the Spanish state & abroad cited further co-operation with amongst others the intelligence services of France & the UK. The Spanish state will celebrate a general election on the 9th of March almost 4 years after the M11 massacre which was falsely attributed to ETA by the then right wing regime. Nobody wants to talk about bombs now - but we should all the same.
Perils come with renting out home for Super Bowl
Valley residents have been finding all sorts of ways to capitalize on the overload of tourists arriving in Phoenix for the Super Bowl and FBR Open. Whats the easiest way to make a large sum of money quickly? Rent your home to last-minute fans willing to pay top dollar for a place to stay. But insurance and real estate experts warn that renting out your house for big money may be a big mistake. (Your home) is supposed to be a personal residence, Scottsdale State Farm insurance agent Tom Napral said. When somebodys using it as a business exposure, it changes that residence. A business exposure, Napral explained, is when a person takes compensation for a service. In this case, letting a person use your home for a fee would create business exposure. If something were to happen while that person was paying to use a home, insurance can then deny to cover a claim, Napral said.
